TERMS & CONDITIONS
Article 1. Applicability
1.1 These General Terms and Conditions apply to all offers, orders and agreements of The Classic Edit. 1.2 Accepting an offer or placing an order means that you accept the applicability of these Terms and Conditions. 1.3 The provisions of these Conditions can only be deviated from in writing, in which case the other provisions remain in full force. 1.4 All rights and claims, as stipulated in these Conditions and in any further agreements for the benefit of The Classic Edit, are also stipulated for the benefit of intermediaries and other third parties engaged by The Classic Edit . 1.5 A breach or violation of any of the Terms will result in an immediate termination of your Services with The Classic Edit. The Classic Edit reserves the right to refuse service to anyone for any reason at any time.
Article 2. Offers / agreements
2.1 An agreement is only concluded after acceptance of your order by The Classic Edit. The Classic Edit is entitled to refuse orders or to attach certain conditions to the delivery. If an order is not accepted, The Classic Edit will notify you of this within five working days after receipt of the order.
Article 3. Prices and payments
3.1 The prices stated for the products and services offered are in euros, and VAT is included in the price. Import duties are for the consumer. 3.2 Payment can be made via iDEAL telebanking, PayPal or bank transfer. In case of payment by bank or giro the date of payment is the date of crediting the giro or bank account of The Classic Edit. 3.3 If the payment term is exceeded, The Classic Edit can decide whether or not the order will be canceled.
Article 4. Shipping / delivery / return
4.1 We ship within Europe. 4.2 Shipping (Insured by the shipping company) within The Netherlands via POSTNL or DHL. It is possible for the order to be delivered in The Netherlands but only on agreement. Shipping is at your own risk. After we receive the payment we ship your item between 2-3 working days. 4.3 See our shipping page for details. We are not responsible for the duration of the delivery. 4.4 As soon as your item is shipped you will receive your shipping number so you can track your item at any time. Import duties, taxes or any other costs associated with importing the purchased item are not the responsibility of The Classic Edit. These costs are for the buyer. Please always check your country's import duties 4.5 If the item you ordered is not available The Classic Edit will contact you within 1-2 working days. 4.6 Return Policy, in the European Union, you have the right to cancel or return your order within 14 days, for any reason and without a justification. Your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase. The return shipping costs are for the customer.
Article 5. Reservation of ownership
5.1 The ownership of the delivered products is only transferred if you have paid all that you owe to The Classic Edit on the basis of any agreement. The risk with regard to the products already passes to you at the moment of delivery.
Article 6. Intellectual and industrial property rights
6.1 You must fully and unconditionally respect all intellectual and industrial property rights resting on the products delivered by The Classic Edit . 6.2 The Classic Edit does not guarantee that the products delivered to you do not infringe on any (unwritten) intellectual and / or industrial property rights of third parties.
Article 7. Guarantee for authenticity
7.1 The Classic Edit guarantees that the products to be delivered meet the usual requirements and standards that can be imposed on them and are free of any defects. 7.2 If you have purchased an item from The Classic Edit and have doubts about authenticity, please contact us directly. You can then have the item authenticated for authenticity by a third party. The costs are for the buyer.
Article 8. Force majeure
8.1 Without prejudice to the other rights to which it is entitled, in the event of force majeure The Classic Edit has the right, at its own discretion, to suspend the execution of your order, or to dissolve the agreement without judicial intervention, this by informing you in writing. and without The Classic Edit being obliged to pay any compensation, unless this would be unacceptable in the circumstances to the standards of reasonableness and fairness. 8.2 Force majeure means any shortcoming which can not be attributed to The Classic Edit, because it is not due to its fault and not under the law, legal act or generally accepted for its account.
Article 9. Miscellaneous
9.1 If you provide The Classic Edit an address in writing, assuming you are entitled to send orders to this address.
9.2 If The Classic Edit allows deviations from these Conditions, whether or not tacitly, for a short or longer period, this shall not affect its right to demand immediate and strict compliance with these Conditions. You can never assert any right on the grounds that The Classic Edit applies these Conditions smoothly. 9.3 The Classic Edit is authorized to use third parties in the execution of your order (s).
Article 10. Applicable law and competent court
10.1 Dutch law applies exclusively to all rights, obligations, offers, orders and agreements to which these Terms and Conditions apply, as well as to these Terms and Conditions. 10.2 All disputes between parties will only be submitted to the competent court in the Netherlands. Copyright / Copyright 11.1 On all images or parts of images that are available on this website without the express permission of the author, copying of prints or complete sections of the text of downloaded documents is strictly prohibited by copyright.
